Adjusters are trained to be pleasant and helpful. Their job, however, is to close your claim for the smallest amount the file will justify.

Tactics you should expect

  • A quick settlement offer before treatment is complete
  • A recorded statement designed to capture admissions
  • Requests for medical records unrelated to the crash
  • Claims that your injuries are pre-existing or degenerative
  • Long delays intended to create financial pressure
  • Suggestions that hiring a lawyer will 'slow everything down'

How to respond

You are required to cooperate with your own insurer, not the at-fault driver's. You are not required to give a recorded statement, guess at your future prognosis, or sign an unlimited records release.

Keep communication in writing where you can, and route settlement discussions through counsel once you are represented.
